1. Acceptance of terms
By creating an account or using RealtyEngine AI (the "Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of a brokerage or other organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
RealtyEngine AI turns a listing URL into marketing assets, including AI-generated walkthrough films, MLS-safe and branded listing copy, social captions, email content, open-house flyers, and a hosted property microsite. Generated content is a visualization produced from listing photography and public listing data — it is not a recording of the property and should be labeled as such where required by law or MLS rule.
3. Accounts
- You must provide accurate account information and keep your login credentials secure.
- You are responsible for all activity that occurs under your account.
- We may suspend or terminate accounts that violate these Terms or applicable law.
4. Billing and credits
- Paid plans are billed on a subscription or credit basis as described at checkout. Fees are non-refundable except where required by law.
- Credits are consumed when you generate assets and do not roll over unless stated otherwise on your plan.
- We may change pricing with notice; continued use after a price change constitutes acceptance.
- You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period.
5. Acceptable use
You agree not to use the Service to:
- Generate or publish content that violates fair housing law, including discriminatory language regarding race, color, religion, sex, disability, familial status, or national origin.
- Upload listing data or images you do not have the right to use.
- Misrepresent AI-generated films or images as authentic video or photography of the property.
- Attempt to reverse-engineer, scrape, or overload the Service infrastructure.
RealtyEngine AI includes an automated fair-housing screening layer, but you remain solely responsible for reviewing and approving all content before publication.
6. Content ownership
- You retain ownership of the listing data, photos, and brand assets you upload.
- You own the marketing assets generated for your listings and may use them for lawful marketing purposes.
- You grant RealtyEngine AI a limited license to process your uploaded content solely to operate and improve the Service.
- RealtyEngine AI retains ownership of the underlying software, models, and templates.
7. Third-party data and services
The Service may import listing data from third-party sources (such as MLS feeds or Zillow) and rely on third-party infrastructure (including Supabase, Stripe, and AI generation providers) to operate. We are not responsible for the accuracy of third-party listing data or for outages of third-party providers.
8. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated content may contain errors; you are responsible for reviewing all output before publishing or distributing it.
9. Limitation of liability
To the maximum extent permitted by law, RealtyEngine AI and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid for the Service in the twelve months preceding the claim.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or misuse the Service in a way that creates legal or reputational risk.
11. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, unless otherwise required by applicable local law.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
